GOLF SKATE CADDY - WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

In consideration of being allowed to use the GSC Tourer:

Acknowledgment of Risks

The Player acknowledges that the use of the GSC Tourer involves certain inherent risks, dangers and hazards, including but not limited to the potential for serious personal injury, property damage, and death.

 Waiver of Liability

The Player, for themselves and their heirs, executors, administrators, assigns, and for all members of their family, hereby fully and forever releases, waives, discharges and covenants not to sue the Club, its affiliates, employees, agents, representatives, successors and assigns from any and all claims, demands, damages, actions, causes of action, suits, debts, contracts, judgments, executions or liabilities, of any kind or nature, whether known or unknown, in law or equity, arising from or in any way related to player's use of the GSC Tourer, including without limitation any claims for personal injury or property damage.

 Indemnification

The Player agrees to indemnify, defend, and hold harmless the Club, its affiliates, employees, agents, representatives, successors and assigns from and against any and all claims, demands, damages, actions, causes of action, suits, debts, contracts, judgments, executions or liabilities, of any kind or nature, arising from or in any way related to player's use of the GSC Tourer, including without limitation any claims for personal injury or property damage.

 Assumption of Risk

The Player acknowledges that they are using the GSC Tourer at their own risk and voluntarily assumes all risks associated with such use, including the risk of injury or death.

 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Golf Club.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, and agreements between the parties, whether written or oral.

Severability

If any term or provision of this Agreement shall be held to be illegal, unenforceable, or invalid for any reason, such illegal, unenforceable or invalid provision shall be severable and shall not affect the validity or enforceability of the remaining provisions.
